Welcome to Globext. These Terms and Conditions (“Terms”) govern your use of our website https://globext.ca (the “Site”) and the purchase of custom apparel and related products from Globext Inc. (“Globext,” “we,” “us,” or “our”).

2. ACCEPTANCE OF TERMS

By using our Site, creating an account, or placing an order, you:

3. PRODUCTS AND SERVICES

3.1 Custom Apparel

Globext specializes in custom-designed apparel including t-shirts, hoodies, caps, and other clothing items. All products are made-to-order based on customer specifications and design choices.

3.2 Product Accuracy

We make every effort to display our products as accurately as possible. However:

• Colors may vary slightly due to screen settings and printing processes
• Actual product sizes may have a tolerance of ±2cm
• Fabric textures and finishes may vary slightly from images
• Product images are for illustration purposes and may not represent the final custom product

3.3 Design Approval

For custom orders, we may provide a design proof for your approval before production. Once you approve a design, changes may not be possible, and the order becomes final.

4. PRICING AND PAYMENT

4.1 Prices

• All prices are displayed in Canadian Dollars (CAD) unless otherwise stated
• Prices include applicable taxes (GST/QST) as required by law
• Prices are subject to change without notice, but orders already placed will honor the price at the time of purchase
• Shipping costs are calculated at checkout based on destination and shipping method

4.2 Payment Methods

We accept the following payment methods:

• Credit cards (Visa, Mastercard, American Express)
• Debit cards
• Other payment processors as indicated at checkout

4.3 Payment Processing

Payment is processed at the time of order placement. By providing payment information, you confirm that you are authorized to use the payment method and that there are sufficient funds available.

5. ORDERS AND PRODUCTION

5.1 Order Confirmation

After placing an order, you will receive an email confirmation. This confirmation does not constitute acceptance of your order. We reserve the right to refuse or cancel any order for reasons including:

• Product unavailability
• Errors in product or pricing information
• Fraudulent or unauthorized transactions
• Designs containing offensive, illegal, or infringing content

5.2 Production Time

• Custom orders typically require 5-10 business days for production
• Complex designs or bulk orders may require additional time
• Production time does not include shipping time
• We will notify you of any significant delays

5.3 Order Modifications and Cancellations

• Orders can be modified or cancelled within 24 hours of placement by contacting us
• Once production has begun, orders cannot be cancelled or modified
• Custom/personalized orders are non-refundable once production begins

6. SHIPPING AND DELIVERY

6.1 Shipping Area

We ship within Canada and to select international destinations. Shipping costs and delivery times vary by location.

6.2 Delivery Times

• Standard shipping: 5-7 business days within Canada
• Express shipping: 2-3 business days within Canada
• International shipping: 10-21 business days depending on destination
• Delivery times are estimates and not guaranteed

6.3 Shipping Responsibility

• You are responsible for providing accurate shipping information
• We are not responsible for delays caused by incorrect addresses
• Risk of loss passes to you upon delivery to the carrier
• For lost or damaged shipments, you may need to file a claim with the carrier

7. RETURNS, EXCHANGES, AND REFUNDS

7.1 Return Policy

Quebec Consumer Protection: Under Québec’s Consumer Protection Act, distance contracts (online purchases) are subject to specific cancellation rights and information requirements.

7.2 Custom Products

• Custom-designed and personalized products are non-refundable and non-exchangeable unless defective or damaged
• This applies to all products customized with your designs, text, or specifications

7.3 Defective or Damaged Products

If you receive a defective or damaged product:

• Contact us within 7 days of delivery with photos of the defect/damage
• We will assess the issue and provide a replacement or refund at our discretion
• Products must be unused and in original condition (except for the defect)

7.4 Wrong Item Shipped

If we ship the wrong item, we will arrange for a replacement or full refund at no cost to you.

7.5 Return Shipping

• We cover return shipping costs for defective or incorrect items
• Customer error returns (if accepted) require customer to pay return shipping

8. WARRANTY (QUÉBEC LAW COMPLIANCE)

As of October 30, 2026, new warranty provisions under Québec’s Consumer Protection Act apply. All products sold come with:

• A warranty of good working order for a reasonable period based on the product type
• Products must be durable, safe, and suitable for normal use
• If a product fails within a reasonable time, you may be entitled to repair, replacement, or refund

9. USER ACCOUNTS

9.1 Account Creation

You may create an account to place orders and track purchases. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

9.2 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

10. INTELLECTUAL PROPERTY

All content on the Site, including logos, designs, text, graphics, and images, is owned by Globext or our licensors and is protected by copyright, trademark, and other intellectual property laws.

10.2 Customer Designs

• You retain ownership of any original designs you submit
• By submitting designs, you grant us a license to reproduce them on your ordered products
• You represent that you own or have rights to use any designs you submit
• You are responsible for ensuring your designs do not infringe third-party rights

10.3 Prohibited Designs

We reserve the right to refuse designs that:

• Infringe copyright, trademark, or other intellectual property rights
• Contain offensive, discriminatory, or illegal content
• Violate any applicable laws or regulations

11. PROHIBITED USES

You agree not to use the Site or our services to:

• Violate any laws or regulations
• Infringe intellectual property rights
• Transmit harmful or malicious code
• Engage in fraudulent activity
• Harass, abuse, or harm others
• Interfere with Site functionality or security
• Use automated systems to access the Site without permission

• Your violation of any rights of another party
• Designs or content you submit that infringe third-party rights

15. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts located in Montréal, Québec, Canada.

16. DISPUTE RESOLUTION

If you have a complaint or dispute, please contact us first at globext.infos@gmail.com. We will work in good faith to resolve the issue.

Quebec residents may also contact the Office de la protection du consommateur du Québec for assistance with consumer disputes.

17. CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site with an updated “Last Updated” date.

Your continued use of the Site after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

18. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

19. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Globext regarding use of the Site and supersede all prior agreements.
